Terms of Acceptable Use

Introduction
- This policy outlines what Faith Computing Pty Ltd (hereafter referred to as "Faith", "we" or "our") deem to be unacceptable use of the services we provide to you our customers (hereafter to as "customer", "you" and "your").
- From time to time we may update this policy. When we make amendments to this policy we will notify you of the change; after which you will be obliged to comply with the amended policy.
- Legitimate meanings are not altered or invalidated if you misunderstand these or other verbal explanations, or where minor grammatical variants do not alter the intended meaning.
Agreement by customers to comply with the AUP
- To access and use any services supplied by us, you must agree to these terms. If you do not understand anything you find here, please ask for it to be explained.
- Your decision to purchase any service from us signifies your acceptance of the terms of this policy.
- If you do not these terms, whether this version, or any future version, you must contact us immediately with indication that you wish to cancel your services.
To whom does the policy apply
- The policy applies all persons or entities using services provided by Faith, including business owners and their representative operators. It also applies to any person who wishes to complain about a suspected breach of this policy.
- Any use of services that contravenes the Commonwealth and/or State laws governing Internet use is unacceptable use.
- Any use of services in a way that contravene, restrict, endanger the good name of or unfairly impedes our information technology or other systems is unacceptable use.
Services covered by this policy
- This policy covers all services provided by Faith.
- You also agree under the terms of this agreement, to observe and comply with any policies in place by a service provider accessed to you though our network.
Faith's Responsibilities
- We will take reasonable measures to ensure that all users of our services comply with this policy.
- We reserve the right to monitor your compliance by any means and to take action if we deem it necessary.
- We reserve the right to act on any complaint received and will cooperate and assist fully with law enforcement agencies if required.
- We will report breaches of this policy to appropriate law enforcement agencies where deemed present.
Customer Responsibilities
- You must not use, attempt to use, or allow use of our service in a way that results in you or Faith being in breach of a law, order or regulation.
- You must not use, attempt to use, or allow use of our service in a way that causes obscene, defamatory, offensive or abusive material to be made known or available.
- You must not use, attempt to use, or allow use of our service in a way that enables interactive communications with establishes (or seeks to establish) contact with a minor not otherwise known to you.
- You must not use, attempt to use, or allow use of our service in a way that communicates or makes available materials a reasonable person would consider unsuitable for minors or is classified as RC or X by the Australian Classification Board. You must not use, attempt to use, or allow use of our service in a way that infringes on any person's rights (intellectual property rights and moral rights included).
- You must not use, attempt to use, or allow use of our service in a way that misuses confidential information.
- You must not use, attempt to use, or allow use of our service in a way that results in you breaching an obligation that you owe to any person.
- You must not use, attempt to use, or allow use of our service in a way that is illegal, misleading, deceptive, or a marketing practice that promotes an illegal activity.
- You must not use, attempt to use, or allow use of our service in a way that results in, or could result in, damage to people or property.
- You must not use, attempt to use, or allow use of our service in a way harasses, menaces or stalks people or enterprises.
- You must not use, attempt to use, or allow use of our service in a way that has a spamming effect. This includes messages that are indiscriminate, unsolicited, unwanted, inappropriate, commercial advertising enmasse, adversely impacting on a computer, network or other parties data, accessing anyone else's system, empowering to third parties to do similar, or that seeks to hide or obscure you as the source of a message or action.
- You must not use, attempt to use, or allow use of our service in a way that impacts negatively upon our ability to provide our services.
- You must not use, attempt to use, or allow use of our service in a way that unfairly damages the commercial well being or reputation of Faith.
- You must not use, attempt to use, or allow use of our service in a way that excessively uses resources such that our servers, network, or other resources are burdened in a way that other customers or the services of Faith in general suffer unfairly. This includes services listed as 'unlimited'. We reserve the right to charge overage or additional appropriate fees for uncharacteristic or exploitive levels of usage.
What will happen in cases of unacceptable use

- We reserve the right to decide whether any action constitutes unacceptable use and, to the extent the law allows, our decision will be final.
- If directed to close an account immediately by a law enforcement agency or relevant government authority we will do so.
- We reserve the right to suspend or terminate your account without notice if we deem the circumstances require it. At our absolute discretion, we reserve the right to suspend or terminate a customer's access to any or all services if this policy is breached.
Liabilities and indemnities
We will not be liable for any loss of benefit you might incur if we suspend or terminate your account.
You agree to indemnify Faith against any claim a user or another customer might make as a result of any loss of benefit or damages they incur as a result of a breach.Agreement Ends.
